I may be wrong, but I believe every Governor has the right to declare a State of Emergency and deploy the Guard w/o permission from the Feds to handle said emergency. Fires, floods, riots,blizzards,etc. doesn’t need a go ahead from Washington. The Individual State has to pay for it, though. So why doesn’t Perry call up the Texas National Guard and have them Patrol the Border? Why wait on Obama to step up? Posse Comitatus only applies to Federal Troops doing Law Enforcement, not States. Or is he just being a Politician, generating Sound Bites for his next Campaign?

The State of Texas should buy/eminent-domain a quarter mile wide strip of land along the border, outside of Big Bend Park, if needed.
Make it a state military reservation, and control who is allowed to cross it.
Last time we were attacked by a foreign country – and when we had a real president – we kicked their ass.
